Board of Education nominating petitions available

Are you interested in running for the board?

Qualified residents (see qualifications below) interested in running for the Watervliet Board of Education may pick up candidate nominating petitions in the district office located at 1245 Hillside Drive, Watervliet, on regular business days between the hours of 8:00 a.m. and 4:00 p.m.

Candidates for open seats on the Board of Education must file a petition signed by at least one-hundred (100) qualified voters of the school district.  Petitions must include the name and the residence of the candidate, and the name and residence of the signing petitioner.

Vacancies on the Board of Education are not to be considered separate specific offices, and nominating petitions in such case are not to describe any specific vacancy for which the candidate is nominated.

All school board candidate nominating petitions must be filed with the District Clerk no later later than 5:00 p.m. on April 29, 2020

Complete board nominating petition packets are available in the District Office for anyone who is interested in running for a Board of Education seat. Nominating packets include the following:

Qualifications

To qualify to run for a seat on the Board of Education, state law requires candidates meet the following criteria:

  • Must be able to read and write
  • Must be a qualified voter of the district, that is: a citizen of the United States, at least 18 years of age or older, and not adjudged to be mentally incompetent.
  • Must be and have been a resident of the Watervliet City School District for a continuous and uninterrupted period of at least one year immediately before the election.
  • May not have been removed from any school district office within the preceding year.
  • May not reside with another member of the same school board as a member of the same family.
  • May not be a current employee of the school board.
  • May not simultaneously hold another incompatible public office.

All Watervliet school board members serve at large for no pay. The candidates who receive the highest number of votes on school budget day will be elected to three-year terms of office.

Procedure for Filing a Petition

Candidates for the position of member of the Board of Education must file a petition with the Clerk of the School District signed by at least one-hundred (100) qualified voters of the District. Such petition shall state the name and the residence of the candidate, and the name and residence of each petitioner.
Vacancies on the Board of Education are not to be considered separate specific offices, and nominating petitions in such case are not to describe any specific vacancy for which the candidate is nominated.

Each petition shall be filed with the Clerk of the District not later than 5:00 p.m. on April 29, 2020.

The candidate(s) who receive(s) a majority of the votes cast shall be declared elected. (Education Law Section(s) 2002, 2013, 2018)

Procedure for Election Expenditure Filing

If a school board candidate’s campaign expenditures exceed $500, the candidate must file a sworn statement with both the district clerk and the commissioner of education itemizing their expenditures.

This statement must list the amounts of all money or other valuable things paid, given, expended or promised by the candidate, or incurred for or on the candidate’s behalf with his or her approval.

A candidate who spends $500 or less is only required to file a sworn statement with the district clerk indicating this to be the case. No other campaign expenditure statement is required.

A preliminary statement must be filed at least 5 days before the election, and a final statement must be filed within 20 days after the election. The statement must cover the period up to and including the day next preceding the day specified for the filing of the statement. (Education Law Section 1528-1531)

Procedure for Determining Order of Names on Ballot

The order of names of candidates for school boards will be determined by lot one day after the final day of filing. Please be advised that the drawing for lots for position on the ballots for the Annual School District Meeting and Election of the Watervliet City School District will take place at the District Office, 1245 Hillside Drive, Watervliet, NY on Thursday, April 30, 2020, at 9:00 a.m.
